Please read these Terms and Conditions carefully before using our services. By requesting or using A&N Towing Inc. services, you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction), have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms and Conditions.

1. Introduction

Welcome to A&N Towing Inc. These Terms and Conditions govern your use of our towing and roadside assistance services. By requesting or using our services, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, please do not use our services.

2. Definitions

  • “Company,” “we,” “us,” or “our” refers to A&N Towing Inc.
  • “Client,” “you,” or “your” refers to the individual or entity requesting towing or roadside assistance services, who must be at least 18 years of age or the legal age of majority
  • “Services” refers to towing, roadside assistance, vehicle recovery, and all related services we provide
  • “Vehicle” refers to the car, truck, equipment, or machinery being serviced
  • “Dispatch” refers to the point at which our driver is assigned and en route to your location

3. Services Provided

A&N Towing Inc. provides the following services primarily in the Bridgeview, Illinois area, including surrounding communities within Cook County and adjacent areas. Services provided outside the primary Bridgeview service area may be subject to additional fees, which will be disclosed at the time of the service request.

  • Emergency towing services
  • Vehicle accident recovery
  • Winch-outs and off-road recovery
  • Tire changes
  • Jump starts
  • Lockout services
  • Fuel delivery
  • Light-duty towing
  • Medium-duty towing
  • Equipment and machinery hauling

Service availability and pricing are subject to vehicle type, location, and service requirements. We reserve the right to decline service if we determine our equipment is not suitable for the job.

4. Service Requests and Dispatch

  • You may request services by phone, through our website, or via contact initiated through Google Ads
  • When you request service, you must provide accurate information about your location, vehicle, and service needs
  • We will provide you with an estimated arrival time and service cost
  • Once a driver is assigned and dispatched to your location, the service is considered active
  • You are responsible for ensuring the vehicle owner’s consent for any services requested
  • For services requested by phone, our dispatcher will verbally confirm your agreement to these Terms and Conditions at the time of the service request. Your continued request for service constitutes your acceptance of these terms.

5. Deposit and Payment Terms

5.1 Deposit Requirement

For certain services, we may require a deposit of 50% of the total estimated service cost before dispatching a driver. The deposit requirement will be communicated to you when you request service.

5.2 Deposit Application

  • The deposit will be subtracted from the total service cost upon completion of the job
  • You will pay the remaining balance after services are rendered
  • If the final cost is less than estimated, you will be refunded the difference
  • If the final cost exceeds the estimate, you will be responsible for the additional amount

5.3 Payment Methods

We accept the following payment methods:

  • Cash
  • Credit cards
  • Debit cards
  • Peer-to-peer payment platforms (e.g., Zelle, Venmo, Cash App). Please note that peer-to-peer payments may have limited dispute and chargeback protections. By choosing this method, you accept the associated risks.

5.4 Payment Due

  • Payment for services is due upon completion
  • For towing services, your vehicle may be held until payment is received in full
  • Failure to pay may result in storage fees and legal action

6. Cancellation and Refund Policy

6.1 Cancellation Before Dispatch

If you cancel your service request BEFORE our driver is dispatched:

  • Any deposit paid will be fully refunded
  • You must notify us of the cancellation as soon as possible
  • Refunds will be processed within 5–7 business days

6.2 Cancellation After Dispatch

If you cancel your service request AFTER our driver has been dispatched and is en route to your location:

  • The deposit is NON-REFUNDABLE
  • You will forfeit the entire 50% deposit
  • This policy compensates us for driver time, fuel, and lost opportunity to serve other customers
  • No additional service call fee will be charged beyond forfeiture of the deposit

6.3 Service Cannot Be Completed by A&N Towing

If we are unable to complete the service upon arrival due to: equipment limitations or malfunctions, site difficulties or unsafe conditions, or any other reason beyond your control, then:

  • The deposit will be FULLY REFUNDED
  • You will not be charged for the service attempt
  • Refunds will be processed within 5–7 business days

6.4 Service Refused by Client

If our driver arrives at your location and you refuse service for any reason (change of mind, disagreement with cost, etc.):

  • The deposit is NON-REFUNDABLE
  • No additional service call fee will be charged beyond forfeiture of the deposit

7. Client Responsibilities

When requesting our services, you agree to:

7.1 Accurate Information

  • Provide accurate location, vehicle, and service requirement information
  • Update us immediately if your location or situation changes
  • Provide truthful information about vehicle weight, condition, and any special circumstances

7.2 Vehicle Access and Preparation

  • Ensure the vehicle is accessible for towing or service
  • Remove all personal belongings before towing (we are not responsible for items left in the vehicle)
  • Notify us of any special equipment, aftermarket modifications, or conditions that may affect service. Failure to disclose such information may limit our liability for resulting damage.

7.3 Safety and Cooperation

  • Maintain a safe distance from our equipment and work area
  • Follow all safety instructions provided by our driver
  • Cooperate with our driver to facilitate safe and efficient service

8. Authorization and Vehicle Ownership

  • You represent that you are the owner of the vehicle or have authority to request service on behalf of the owner
  • We may require proof of ownership or authorization before providing service
  • We are not responsible for disputes regarding vehicle ownership or authorization
  • For abandoned or impounded vehicles, additional documentation may be required

9. Vehicle Condition Documentation

Prior to loading or beginning service, our driver may photograph or document the condition of your vehicle. This pre-service inspection record protects both you and A&N Towing Inc. in the event of a damage dispute. You are encouraged to be present during this inspection. If you are not present, the driver’s documentation will serve as the baseline record of the vehicle’s pre-service condition.

10. Liability and Insurance

10.1 Our Liability

A&N Towing Inc. is fully insured and will exercise reasonable care when handling your vehicle. We are liable for damage to your vehicle caused by our negligence or improper handling during: loading and unloading, transportation, and recovery operations.

10.2 Limitations of Liability

We are NOT liable for:

  • Pre-existing damage to the vehicle
  • Damage caused by the condition or design of the vehicle
  • Damage to low-clearance vehicles during normal towing operations
  • Damage to aftermarket modifications or accessories not disclosed to us prior to service
  • Personal property left in the vehicle
  • Mechanical failure or breakdown unrelated to towing
  • Damage resulting from vehicle defects or hidden damage revealed during towing

10.3 Damage Claims

To file a damage claim:

  • You must inspect your vehicle immediately upon delivery and report any damage
  • Claims must be reported to us within 72 hours of service completion. Claims submitted after this period may not be accepted.
  • Provide photos and a detailed description of the damage
  • Allow us to inspect the damage before any repairs are made. Repairs made prior to our inspection may void the claim.

11. Subcontractors and Third-Party Providers

A&N Towing Inc. may occasionally use vetted subcontractors or partner drivers to fulfill service requests. Any such subcontractors operate under our supervision and are required to adhere to our standards of care. We remain responsible to you for the quality of service provided, subject to the limitations set forth in these Terms and Conditions.

12. Emergency and After-Hours Services

  • We provide 24/7 emergency towing and roadside assistance
  • Emergency and after-hours services may be subject to additional fees, which will be disclosed at the time of the service request
  • Response times may vary based on weather, traffic, and service demand
  • We make reasonable efforts to arrive as quickly as possible but cannot guarantee specific arrival times. Estimated arrival times are not guarantees.

13. Vehicle Storage and Impound

  • If your vehicle is towed to our facility, storage fees may apply
  • Storage fees begin 24 hours after the vehicle arrives at our facility. Current storage fee rates are available upon request by calling (708) 963-2227 or emailing towing@aandntowing.us.
  • You are responsible for all accrued storage fees until the vehicle is released
  • We reserve the right to place a lien on vehicles with unpaid charges in accordance with the Illinois Vehicle Code, 625 ILCS 5/18a-200 et seq.
  • Unclaimed vehicles may be disposed of according to Illinois law, including applicable provisions of 625 ILCS 5/18a-200 et seq. and relevant local ordinances

14. Warranties and Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner consistent with industry standards. However, we do not guarantee:

  • Specific arrival times (estimates are not guarantees)
  • That roadside assistance will fully resolve your vehicle issue
  • The condition of your vehicle after an accident or recovery situation beyond what is caused by our own negligence

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE CLAIM.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST WAGES, LOST PROFITS, RENTAL CAR COSTS, INCONVENIENCE, OR LOSS OF USE OF YOUR VEHICLE.

Some states do not allow certain limitations of liability, so some of the above limitations may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless A&N Towing Inc., its officers, employees, agents, and subcontractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

  • Your failure to provide accurate information
  • Your lack of authorization to request service for the vehicle
  • Your negligence or willful misconduct
  • Third-party claims related to the vehicle
  • Your violation of any laws or regulations

17. Dispute Resolution

We encourage you to contact us first to resolve any dispute informally. Please submit written complaints to: A&N Towing Inc., 8400 S Oketo Ave, Bridgeview, Illinois 60455, or by email to towing@aandntowing.us. We will make reasonable efforts to respond within 10 business days.

If an informal resolution cannot be reached, the parties agree to attempt resolution through non-binding mediation before initiating litigation. If mediation is unsuccessful, any remaining disputes shall be resolved in the courts of Cook County, Illinois. You consent to the exclusive jurisdiction and venue of such courts.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

18. Force Majeure

We shall not be liable for delays or inability to perform services due to circumstances beyond our reasonable control, including: severe weather conditions, natural disasters, acts of God, road closures or traffic incidents, government actions or restrictions, and public emergencies. Equipment failure due to normal wear and tear or lack of maintenance does not constitute a force majeure event and does not limit our obligations under these Terms.

19. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. Our Privacy Policy is incorporated into these Terms and Conditions by reference.

20. Non-Discrimination

A&N Towing Inc. provides services without regard to race, color, religion, national origin, sex, age, disability, or any other characteristic protected by applicable federal, state, or local law.

21. Accessibility

A&N Towing Inc. is committed to ensuring that our website is accessible to people with disabilities. We strive to meet the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards. 22. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and A&N Towing Inc. regarding our services and supersede all prior agreements and understandings, whether written or oral.

24. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. For material changes, we will provide at least 14 days’ notice by posting a prominent notice on our website and, where possible, notifying you via email. The effective date at the top of this page will be updated with each revision. Your continued use of our services after the effective date of any changes constitutes your acceptance of the modified terms. Prior versions of these Terms are available upon request.
